TERMS OF SERVICE

These Terms of Service (“Terms”) are a legally binding agreement between you (“you”, “User”) and TaleSpace LLC (“TaleSpace”, “we”, “us”, or “our”). By accessing or using the website, mobile applications, and services provided by TaleSpace (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. DEFINITIONS
   “Account” — your registered user account.
   “Subscription” — any recurring paid plan granting access to content or features.
   “Gems” — virtual, non-monetary, non-transferable tokens used inside the Service to access premium content or features.
   “Content” — all text, images, audio, video, code, translations, and other materials delivered via the Service, including content created or assisted by automated systems (including AI).

2. ELIGIBILITY
   You must be at least 18 years old (or the minimum age required by your local law if higher) to create an Account and use the Service. The Service is not intended for children under the applicable local minimum age. If you are under the age required by local law, you must not create an Account or use the Service.

3. SCOPE OF SERVICE
   TaleSpace provides access to digital literary works and related services. Content may be created by our team, independent authors, contractors, or created/assisted/translated using automated systems including artificial intelligence. All rights to content on the Service belong to TaleSpace or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

4. SUBSCRIPTIONS, TRIALS, BILLING, AND MONEY-BACK GUARANTEE
   4.1 Subscription Authorization: By subscribing you authorize our payment processor to charge the selected payment method for recurring fees. Our payment processor is Stripe.
   4.2 Auto-Renewal: Subscriptions automatically renew at the end of each billing period. Cancellation prevents future renewals but does not entitle you to a refund for the current paid period. Deleting your account does not automatically cancel your subscription. To cancel, use the account settings provided in the Service or contact support@talespace.club.
   4.3 Free Trials: If a free or discounted trial is offered, the trial automatically converts to a paid Subscription at the end of the trial unless you cancel at least 24 hours before trial expiration.
   4.4 Price Changes: We may change subscription prices. Material changes will be notified in advance; continued use after the effective date indicates acceptance.
   4.5 Money-Back Guarantee (First Payment Only): For Subscriptions (but not for Gems), we offer a money-back guarantee for the first paid billing charge only. To request a full refund of the first subscription charge, you must contact support@talespace.club within 14 days of the date of the first charge. Refunds under this clause apply only to the first payment for a Subscription and do not apply to any subsequent renewals or to purchases of Gems. We reserve the right to refuse refund requests made in bad faith or in cases of suspected fraud or abuse.

5. GEMS (VIRTUAL CURRENCY)
   5.1 Nature of Gems: Gems are virtual, non-monetary, non-transferable licenses that permit access to certain premium content or features within the Service. Gems have no cash value outside the Service and cannot be exchanged for fiat currency.
   5.2 Finality of Purchase: Purchases of Gems are final except as required by applicable law. The money-back guarantee in Section 4.5 explicitly does not apply to Gems.
   5.3 Fraud and Abuse: We may suspend, revoke, or forfeit Gems if we suspect fraud, abuse, chargebacks, or if you otherwise violate these Terms. Upon account termination, unused Gems may be forfeited.

6. REFUNDS, WITHDRAWAL RIGHTS, AND MOBILE STORE PURCHASES
   6.1 General Rule: Except where required by law or Section 4.5 (first-payment money-back guarantee for Subscriptions), all purchases of Subscriptions and Gems are final.
   6.2 EU/EEA/UK — Consent to Immediate Performance: Where local law grants a statutory right of withdrawal for digital content, you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once the performance of the digital contract begins (e.g., when content is made available). If you do not consent, do not complete the purchase.
   6.3 Mobile App Stores: Purchases made through a mobile app store are subject to the respective store’s billing, refund, and dispute processes. For purchases made via such stores, please consult the store’s support for refunds or billing disputes. Relevant platform providers include: Apple App Store and Google Play.

7. PAYMENT DISPUTES, CHARGEBACKS, AND COOPERATION
   Before initiating a chargeback or payment dispute with your bank or card issuer, you must contact support@talespace.club to attempt resolution. Initiating a chargeback without first contacting us may result in account suspension and forfeiture of Gems. You authorize TaleSpace to share relevant transaction logs, IP addresses, and usage records with payment processors, card issuers, and law enforcement to resolve disputes and investigate fraud. We reserve the right to recover chargeback fees and related costs.

8. AI-ASSISTED CONTENT DISCLAIMER
   Some Content may be wholly or partially generated, translated, or processed using AI or other automated systems. AI outputs may contain inaccuracies, unintended similarities to other works, or other issues. TaleSpace does not guarantee absolute originality of AI-assisted content. If you believe Content infringes your rights, follow our DMCA/Copyright policy (Section 14) and contact support@talespace.club.

9. INTELLECTUAL PROPERTY
   9.1 Company IP: All rights, title, and interest in the Service and Site (excluding User Content) are owned by TaleSpace or its licensors.
   9.2 User Content: If you submit or upload content (e.g., comments, stories, images), you grant TaleSpace a perpetual, worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, modify, adapt, publish, translate, and display such content for the purposes of operating and promoting the Service. You represent you own or control the rights to any content you submit and that its use does not violate these Terms or applicable laws.

10. ACCEPTABLE USE AND PROHIBITED CONDUCT
    You will not: (a) copy, scrape, mass-download, systematically extract, or distribute Content (text, images, AI-translated material) not expressly permitted; we may pursue DMCA takedown notices, account termination, and legal action against violators; (b) attempt to reverse engineer or circumvent paywalls or payment systems; (c) engage in fraudulent activity or abuse refund/chargeback policies; (d) upload content that infringes third-party rights or contains unlawful material; (e) deploy bots or automated tools to access the Service in violation of these Terms. We may investigate and suspend accounts suspected of violating these provisions.

11. DMCA AND COPYRIGHT INFRINGEMENT
    If you believe Content on the Service infringes your copyright, send a written DMCA takedown notice to support@talespace.club containing the information required by 17 U.S.C. §512(c). We will respond and may remove allegedly infringing Content. We also provide a process for counter-notices where applicable.

12. TERMINATION AND SUSPENSION
    We may suspend or terminate accounts for violation of these Terms or suspected illegal activity. Upon termination, access to the Service ends and Gems may be forfeited. Termination does not relieve you of obligations incurred prior to termination.

13. DISCLAIMER OF WARRANTIES
    The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, TaleSpace disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. LIMITATION OF LIABILITY
    To the maximum extent permitted by law, TaleSpace’s total liability arising from or related to these Terms or the Service shall not exceed the amount you actually paid to TaleSpace in the 12 months prior to the claim. TaleSpace is not liable for indirect, incidental, special, consequential, or punitive damages.

15. INDEMNIFICATION
    You agree to indemnify and hold TaleSpace and its officers, directors, employees, agents, and affiliates harmless from any claim or demand (including reasonable attorneys’ fees) arising from your breach of these Terms, your content, or your violation of law.

16. GOVERNING LAW, DISPUTE RESOLUTION, AND ARBITRATION
    These Terms are governed by the laws of the State of Wyoming without regard to conflict of laws principles. To the extent permitted by applicable law, disputes between you and TaleSpace shall be resolved by binding arbitration (except for small claims matters that can be brought in court). Where arbitration is permitted, you and TaleSpace waive the right to a jury trial and to participate in a class action. Users may opt out of arbitration by notifying support@talespace.club within 30 days of first accepting these Terms.

17. CHANGES TO TERMS
    We may revise these Terms. For material changes we will provide notice by email and/or in-app notice at least 30 days before changes take effect. Continued use after the effective date means you accept the changes.

18. PRIVACY
    Our Privacy Policy describes how we collect and use personal data. By using the Service you consent to our data practices as described in that Policy.
